Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of LeaseBuilder (the “Service”), a software platform that helps landlords and property managers generate residential tenancy documents in Canada. By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
LeaseBuilder lets you create province-specific residential lease agreements and related notices by entering information into a guided form, which we use to produce a downloadable document. The Service applies the statutory rules and prescribed forms for the province you select. Coverage varies by province and changes over time.
2. No legal advice — you are responsible for your documents
LeaseBuilder is not a law firm, is not a substitute for a lawyer, and does not provide legal advice. We are a self-help document-generation tool. Using the Service does not create a lawyer–client relationship.
You are solely responsible for:
- the accuracy and completeness of the information you enter;
- reviewing each generated document and confirming it fits your situation;
- ensuring the document complies with the law that applies to your tenancy, including any updates to provincial legislation, regulations, or prescribed forms; and
- obtaining independent legal advice where your situation is complex, contested, or uncertain.
Tenancy laws differ by province and change frequently. While we work to keep our rules and forms current, we do not warrant that any document is legally sufficient, up to date, or appropriate for your specific circumstances.
3. Eligibility and accounts
You must be at least the age of majority in your province and able to form a binding contract to use the Service. You agree to provide accurate account information and to keep it current. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at support@leasebuilder.ca of any unauthorized use.
4. Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- enter information you do not have the right to use, or that infringes another person’s rights;
- attempt to access accounts, data, or systems that are not yours;
- probe, scan, disrupt, or circumvent the security or integrity of the Service;
- scrape, copy, or resell the Service or its content except as permitted by these Terms; or
- misrepresent generated documents as legal advice from LeaseBuilder.
5. Your content
You retain ownership of the information you enter and the documents you generate (“Your Content”). You grant LeaseBuilder a limited, non-exclusive licence to host, process, and use Your Content solely to operate and provide the Service to you, including generating, storing, and making your documents available to you. We do not sell Your Content. Our handling of personal information is described in our Privacy Policy.
6. Our intellectual property
The Service — including its software, templates, document logic, design, and trademarks — is owned by LeaseBuilder and its licensors and is protected by intellectual-property laws. Except for the rights expressly granted to you, we reserve all rights. The generated output you create for your own tenancy is yours to use; the underlying platform and templates are not.
7. Plans, fees, and changes
The Service currently offers a free plan that lets you generate and download documents and save them to your account. We may introduce paid plans (for example, “Pro”) with additional features. If you subscribe to a paid plan, the applicable price, billing cycle, and any taxes will be disclosed before you are charged, and additional payment terms will apply. We may change features and pricing on a prospective basis with reasonable notice.
8. Third-party services
We rely on third-party providers (for example, hosting, database, and payment processors) to operate the Service. Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party services we do not control.
9. Disclaimer of warranties
The Service and all documents generated through it are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and legal sufficiency. We do not warrant that the Service will be uninterrupted, error-free, or that any document will achieve a particular legal result. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, LeaseBuilder and its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or for losses arising from a document being found invalid, insufficient, or unenforceable, even if advised of the possibility. To the extent we are found liable, our total aggregate liability for all claims relating to the Service is limited to the greater of the amounts you paid us in the twelve months before the event giving rise to the claim, or CA$100. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless LeaseBuilder from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of your use of the Service, Your Content, your documents, or your breach of these Terms or of applicable law.
12. Suspension and termination
You may stop using the Service at any time and may request deletion of your account. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Provisions that by their nature should survive termination (including Sections 2, 5–6, and 9–11) will survive.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing law and disputes
These Terms are governed by the laws of the province or territory in which the operator of LeaseBuilder is established, together with the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Nothing in these Terms displaces the mandatory consumer-protection rules of your home province or territory, which continue to apply to you where they are engaged. If any provision is found unenforceable, the remaining provisions remain in effect.
